This privacy policy applies to www.qbench.net and the QBench Laboratory Information Management System (QBench) (collectively referred to as the “Service”), owned and operated by QBench Inc.. This privacy policy describes how QBench collects and uses the personal information you provide us and it also describes the choices available to you regarding our use of your personal information and how you can access and update this information. Please read this notice carefully. If there are any terms in this privacy notice that you do not agree with, please discontinue use of the Service immediately.

Comprehensive security measures have been implemented to ensure that only registered users and those people who are provided authorized access can view and interact with your data on QBench. The use of information collected through the Service shall be limited to the purpose of providing the Service for which the client has engaged QBench.

Information You Provide

When registering with an email address, we collect your full name, company or organization name and email address. This may include, but is not limited to:

  • Names, email address, company name, and other similar information
  • When signing up for a paid plan, QBench may collect credit card information and use a third-party intermediary to manage credit card processing. This intermediary is not permitted to store, retain, or use your billing information except for the sole purpose of credit card processing on QBench’s behalf.

QBench only uses your personal information to provide you the Service, contact you regarding the use or potential use of the Service, or to provide you support of your use of the Service. This would not be possible without the aforementioned personal information you provide.

You may also provide personal information about other people, such as their name and email address. This information is used for the sole purpose of completing your request or for whatever reason it may have been provided. QBench does not access, process, or use this information in any way.

Single Sign-On

You can log in to our site using sign-in services from various identity providers, such as Google. These services will authenticate your identity and provide you the option to share certain personal information with us, such as your name and email address to pre-populate our sign-up form.

Blogs and Forums

Our web site offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, please contact us at compliance@qbench.net. Alternatively, if you used a third party application to post such information, you can remove it by either logging into the said application and removing the information or by contacting the appropriate third party application.

Testimonials

We display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent, we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at compliance@qbench.net.

Children’s Personal Information

The Service and Site are not intended for, nor does QBench knowingly collect any personal information from children under the age of 18.

Information We Collect From Your Use of the Services

Cookies and Tracking Technologies

Technologies such as cookies, beacons, tags and scripts are used by QBench and our partners, marketing partners, affiliates, or analytics or service providers, or online customer support providers. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

Do Not Track (DNT)

However, only our analytics and service providers are permitted to track user activity on the Site, and we do not track your online browsing activity on other services over time.

We only share and disclose your information with the third parties named and categorized below, who are only authorized to use your data as necessary to provide services to us. These companies are authorized to use your personal information only as necessary to provide business necessary services to us.

We will not give, sell, rent, share, or loan any data to any third party except as explicitly described in this notice. We may also provide non-person or de-identified summaries or group statistics about our customers, sales, traffic patterns, and related Website information to reputable third-party vendors, but these statistics will include no personal information.

Although QBench owns the software, code, databases, and all rights to the QBench application, you retain all rights to your data.

Privacy Notices by Region

QBench Inc. is considered a Data Processor under GDPR. The account data of all persons using QBench is stored in databases hosted by Amazon Web Services (AWS). All data collected related to your QBench account is stored in AWS’s secure hosting facilities, and is governed by AWS’s Terms of Service, Privacy Policy, and (if applicable) a Business Associate Agreement (BAA) between AWS and QBench.

Your Rights Under GDPR

If you are accessing QBench from the European Economic Area, the United Kingdom, or Switzerland, you have the right to:

  • Access: You have the right to request copies of your personal data (see Accessing and Updating Your Information).
  • Rectification: You have the right to request that QBench correct any information you believe is inaccurate or incomplete (see Accessing and Updating Your Information).
  • Erasure: You have the right to request that QBench erase your personal data, under certain conditions.
  • Restrict processing: You have the right to request that QBench restrict the processing of your personal data, under certain conditions.
  • Object to processing: You have the right to object to QBench processing of your personal data, under certain conditions.

QBench complies with the California Consumer Privacy Act (CCPA), California Online Privacy Protection Act (CalOPPA), and other applicable California Law. Under CCPA, consumers (California residents) have certain rights regarding their personal information, including rights to:

While QBench does not sell our customers’ personal information, you have the right to direct us not to sell certain personally identifiable information that we collect about you through the Services (see Information You Provide). You may also review and request that we change the personally identifiable information that we collect about you through the Service (see Accessing and Updating Your Information).

International Information Transfers

Our servers are located in the United States. If you are accessing QBench Services from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information (see “Who Will Your Information Be Shared With?”).

If you are a resident in the European Economic Area, the data protection and similar laws in the United States may differ from those in your country. However, we will take all necessary measures to protect your personal information in accordance with this privacy notice and applicable law.

How Your Data is Retained

QBench will retain your information for as long as your account is active or as needed to provide you services. We will also retain personal data we process on behalf of our clients for as long as needed to provide services to our client. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

When we have no ongoing legitimate business need to process your personal information (unless a longer retention period is required by law), we will either delete or anonymize such information. If this is not possible (such as if data is stored in backups or archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Accessing and Updating Your Information

If your personal information changes, or if you no longer desire our service, you can modify, update, delete your account information at any time by contacting us at the contact information listed below. We will respond to any requests for access to personal information within 10 days.

QBench stores information under the direction of its clients and in many cases has no direct relationship with the individuals whose personal data it stores.

If you are a customer of one of our Clients and would no longer like to be contacted by one of our Clients that use our service, please contact the client that you interact with directly. If you are a Client and would like to update your account please contact us at compliance@qbench.net.

In many cases QBench has no direct relationship with the individuals whose personal data it stores. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to the QBench client. If the QBench client requests QBench to remove the data, we will respond to their request within 10 business days.

How Your Information is Shared

Except as described in this policy, QBench will not give, sell, rent, share or loan any personal information to any third party. We may disclose such information to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We may also share such information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law. QBench may also provide non-personal, summary or group statistics about our customers, sales, traffic patterns, and related Site information to reputable third-party vendors, but these statistics will include no personal information.

QBench maintains reasonable security measures to protect your information from loss, destruction, misuse, unauthorized access or disclosure. When you enter sensitive information, such as login credentials on our QBench login page, we encrypt the transmission of that information using secure socket layer technology (SSL). These technologies help ensure that your data is safe, secure, and only available to you and to those you provided authorized access. However, no data transmission over the Internet or information storage technology can be guaranteed to be 100% secure due to the nature of the distributed network that is the Internet. Your continued use of the Site or Service constitutes your agreement to be bound by such changes to the privacy policy. Your only remedy, if you do not accept the terms of this privacy policy, is to discontinue use of the Site and Service. If we make any material changes, we will notify you or our client by email sent to the e-mail address on your account or by means of a notice on the Site prior to the change becoming effective.

Business Transactions

QBench may assign or transfer this privacy policy, and your user account and related information and data, to any person or entity that acquires or is merged with QBench, you will be notified via email and/or a prominent notice on our web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
